ORDINANCE 2003-04
AN ORDINANCE AMENDING ORDINANCE 1997-05 PROVIDING FOR THE REGULATION AND LICENSING OF DOGS WITHIN THE CORPORATE LIMITS OF THE CITY OF GASSVILLE, ARKANSAS, PROVIDING FOR LICENSE FEES, PROHIBITING THE RUNNING AT-LARGE OF DOGS AND DECLARING AN EMERGENCY
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS, AS FOLLOWS:
SECTION 1: Section 2 of Ordinance 1997-05 is hereby deleted in full and replaced with the following:
Section 2: Running at large:
1. The owner shall keep his animal under restraint at all times and shall not permit such animal to be at large. Furthermore, the owner shall keep his/her animal from barking or making noise in such a manner that would constitute a nuisance.
2. There shall be no more than three (3) animals which are over six (6) months o!d kept in any home or property that is located in a RESIDENTIAL ZONE and separate consideration must be applied for through due process with the Gassville Planning and Zoning Commission and approved by the City Council if a COMMERCIAL ZONE is involved.
SECTION 2: A!I other provisions of Ordinance 1997-05 are incorporated herein and are to remain in full force and effect.
SECTION 3: The health and safety of the citizens of Gassville, Arkansas and their dogs is of the utmost importance and it is therefore declared that an emergency exists and this ordinance shall be in full force and effect from and after its passage.
