ORDINANCE 2023-01

AN ORDINANCE AMENDING ORDINANCE 2017-02 ESTABLISHING WATER RATES FOR THE WATER SYSTEM OF THE CITY OF GASSVILLE, ARKANSAS IN ACCORDANCE WITH COMPLIANCE OF ACT 605 OF 2021 AND FOR OTHER PURPOSES. 

WHEREAS, Act 605 of the 2021 Arkansas Legislature defines and establishes the City Council of Gassville, Arkansas as the Retail Water Board and outlines their responsibilities; and 

WHEREAS, a rate study in compliance with Act 605 was completed by the Arkansas Rural Water Association including expenses for the system and depreciation of five percent (5%) annually for the system; and 

WHEREAS, the current rates for the city of Gassville water system were determined to be insufficient for expenses and depreciation for the sustainable operation of the system. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS: 

That section 1 of Ordinance 2017-02 is amended as follows: 

SECTION 1. WATER RATES: The City Council of Gassville, Arkansas hereby finds and declares these rates to be in compliance with the duties of the board in accordance with Act 605 and sets the following rates to be charged by the City of Gassville Water Department for services rendered: 
     0-2,000 gallons .................. minimum bill charge $ 17.26
     Per thousand gallons thereafter .............................. $ 8.50

SECTION 2. It is further determined that to cover operational and maintenance increases (inflation) that a three percent (3%) increase shall be added annually each January to the rates until the next scheduled rate study in 2028 or as City Council deems necessary. 

SECTION 3. REPEAL. Any Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
