ORDINANCE 2001-03
AN ORDINANCE AMENDING ORDINANCE NO. 120 WITH REFERENCE TO WNING WITHIN THE CITY LIMITS OF THE CITY OF GASSVILLE, ARKANSAS RELATIVE TO CHANGING AREA ZONED FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-2).
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS:
THAT A PROPER PETITION WAS FILED BY THE PROPERTY OWNER REQUESTING THAT A CHANGE PROPER IN ZONING; THAT SAID PETITION WAS SUBMITTED TO THE PLANNING COMMISSION OF THE CITY OF GASSVILLE, ARKANSAS; THAT NOTICE OF SAID PETITION AND A PUBLIC HEARING THEREON WAS PUBLISHED IN A NEWSPAPER HAVING LOCAL CIRCULATION AS REQUIRED BY ORDINANCE NO. 120; THAT A PUBLIC HEARING WAS HELD; THAT ALL REMONSTRANCES WERE HEARD, AFTER WHICH THE PLANNING COMMISION RECOMMENDED THAT ALL PROPERTY DESCRIBED HEREINAFTER BE REZONED.
THAT THE FOLLOWING REAL ESTATE IN BAXTER COUNTY, ARKANSAS, LOCATED AT 213 EAST MAIN STREET, AND OWNED BY BETTY BYRD, BE, AND IS HEREBY CHANGED IN ZONING FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-2).

FOR REZONING
A part of the NE¼ of NW¼ of Section 33, Township 19 North, Range 14 West, bounded and described as follows: Beginning at the NW corner of the yard fence at a point on the South side of Highway No. 621 and at a point approximately 423.21 feet East of the West line of said forty, run thence East with the fence and along said Highway a distance of 361 feet, more or less to corner, for a point of beginning for the tract herein conveyed; run thence South wlth the fence between the M. E. Church property and the present Mooney lands 137 feet, more or less to corner, run thence West with the fence 183 feet to a point, run thence North 137 feet to a point, run thence East 163 feet to the point of beginning.

That part of the NE¼ NW¼ of Section 33, Township 19 North, Range 14 West, bounded and described as follows:
Beginning at the NW corner of a tract at a point on the South side of Highway #62, at a point approximately 521.21 feet East of the West line of said forty to point of beginning for the tract herein described, run thence East 100 feet to a point (being the NW corner of the Harold Dean Byrd Home Tract) run thence South with the Old fence line 335 feet, more or less, to a point on the North line of Walnut Street; run thence West along Walnut Street 100 feet to a point; run thence North 335 feet, more or less, to the South line of Federal Highway #62, to the point of beginning.
LESS AND EXCEPT:
Part of the NE ¼ NW ¼ of Section 33, Township 19 North, Range 14 West, described as follows: Commencing at the NW corner of the NE ¼ NW ¼ and running South 97.0 feet; thence East 637.0 feet; thence South 128.5 feet to an 8 inch post as shown in County Surveyor's Book "F" at Page 251 for a point of beginning; from the point of beginning continue South 153.9 feet to the North line of Sanford Lane; thence N. 88° 48' 24" W., along said North line, 100.6 feet; thence N. 00 ° 13' 25" E., 151.8 feet; thence East 100.0 feet to the point of beginning, containing 0.35 acre, more or less.
