ORDINANCE NO. 2024-06

AN ORDINANCE TO ESTABLISH NEW COMMERCIAL WATER USER RATES AND COMMERCIAL WATER METER DEPOSIT FEES FOR THE CITY OF GASSVILLE WATER
SYSTEM AND FOR OTHER PURPOSES.

WHEREAS, upon a recommendation from the City of Gassville Water/Wastewater Committee and approved at a City Council meeting (Sept. 17) that new commercial water user rates should be established for commercial water customers of the system; and

WHEREAS, a public hearing was duly advertised and held on Tuesday, October 15, 2024 to hear any remonstrances regarding the proposed new commercial water user rates.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS:

SECTION 1. NEW COMMERCIAL WATER USER RATES: The City Council of Gassville, Arkansas hereby finds and declares these new commerciaI water user rates to be fair and reasonable with the duties of the board regarding fiscal compliance per Act 605 of 2021. The following are the new commerciaI water customer rates established for the City of Gassville water system:

          0-2,000 gallons.....................................$18.86
          Per thousand gallons thereafter...... $9.29

SECTION 2. NEW COMMERCIAL WATER METER DEPOSIT FEE: The following shall be the new commercial customer water meter deposit fee:
          Water meter deposit: $125.00 (one-hundred twenty-five dollars),
          Service fee: $25.00 (twenty-five dollars),
          Total: $150.00 (one-hundred fifty dollars).

SECTION 3. AGREEMENT FOR SERVICES: The billing clerk shall  create and provide a separate service agreement form for commercial customers with the proper amounts for the water meter deposit and service fee.

SECTION 4. RATE STUDY: These new commerciaI water user rates having been established by the city council shall be subject to review in accordance with Act 605 of 2021 including necessary depreciation and operation and maintenance (inflation) needs for the water system.
