ORDINANCE NO. 98-06

AN ORDINANCE ESTABLISHING A MAXIMUM NUMBER OF GARAGE SALES, PORCH SALES, PATIO SALES, YARD SALES AND FOR THE
PURPOSE OF SETTING PERMIT REQUIREMENTS FOR SUCH SALES, AND FOR OTHER PURPOSES.

WHEREAS, there is a need for limiting the number of garage, porch, patio and yard sales an individual in any residential area may have in one calendar year; and

WHEREAS, there is a need for the City of Gassville to pre-authorize any garage, porch, patio or yard sale;

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS :

SECTION 1. It shall be unlawful for any person within the City of Gassville to engage in or carry on any garage sale, porch sale, patio sale, yard sale, or any similar type of sale unless that person first obtains from the Gassville Recorder/ Treasurer, or her agent, a permit to do so. No permit shall be issued for a period in excess of three (3) calendar days. No permit shall be issued until the applicant therefor shall sign 1 statement stating that the said sale shall be of personal property owned by said person or persons, that said property was not purchased for the purpose of resale, and that person requesting the permit has not had more than one similar sale by that person or persons or at that person or persons' property during the previous twelve-month period of time. At the end of sale, all signs and items not sold must be removed from sight.

SECTION 2. Applicant shall be issued a permit subject to the above conditions and the permit must be displayed in plain sight from the street during the hours of sale.

SECTION 3. Penalties.

A The first violation shall carry a fine of $25.00.

B. A second violation, and each subsequent violation thereafter which occurs within two (2) years of the first violation shall be a fine of $100.00 which shall be imposed for each violation.
