ORDINANCE 2023-02

AN ORDINANCE AMENDING SECTION 7 OF ORDINANCE 2019-03 ESTABLISHING A NEW USER CHARGE FEE PER 1,000 GALLONS OF SEWER USAGE IN ACCORDANCE WITH A RATE STUDY COMPLETED FOR COMPLIANCE WITH ACT 605 OF 2021 AND FOR OTHER PURPOSES. 

WHEREAS, Act 605 of the 2021 Arkansas Legislature defines and establishes the City Council of Gassville, Arkansas as the Retail Water Board and outlines their responsibilities: and 

WHEREAS, a rate study in compliance with Act 605 was completed by the Arkansas Rural Water Association including expenses for the sewer system and depreciation of 5% annually for the system; and 

WHEREAS, the current user rates for the City of Gassville sewer system were determined to be insufficient for expenses and depreciation for the sustainable operation of the system. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS: 

That Section 7 of ordinance 2019-03 is amended to read as follows: 

SECTION 7. SEWER USER CHARGE RATES. The City Council of Gassville, Arkansas hereby finds and declares these sewer user charges rates to be in compliance with the duties of the board in accordance with Act 605 and sets the following rates to be charged by the City of Gassville Water department for sewer usage: 

     0 - 1,000 gallons .................... $ 9.16 Minimum Bill
     1,000 gallons or more ......... $ 6.65/thousand

Further, it is determined that to cover operational and maintenance increases (inflation) that a three percent (3%) increase shall be added annually each January to the rates until the next scheduled rate study in 2028 or as City Council deems necessary.
