ORDINANCE 1998-08

AN ORDINANCE PROVIDING FOR THE ZONING OF PROPERTY WITHIN THE CITY OF GASSVILLE, ARKANSAS, ESTABLISHING THE TYPES OF USES OF PROPERTY TO BE ALLOWED IN THE VARIOUS ZONES, ADOPTING A NEW ZONING MAP, REPEALING ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS; 

SECTION I.  IT IS HEREBY ADOPTED BY the City Council of the City of Gassville, Arkansas, for the purpose of establishing rules and regulations with regard to zoning within the City of Gassville, Arkansas, a zoning code prepared by the Gassville Planning and Zoning Commission for the City of Gassville dated October 7, 1997 of which not less than three copies have been filed in the office of the Recorder/Treasurer of the City of Gassville, Arkansas, and a Zoning Map. The same is hereby adopted and incorporated as fully as if set out at length herein, word for word, and from the date on which this Ordinance shall take effect the provisions thereof shall be controlling in the matters regulated thereby within the corporate limits of the City of Gassville, Arkansas. 

SECTION 2. Nothing in this Ordinance or the Code herein adopted shall be construed to effect any suit or proceeding now pending in any Court, any rights acquired, or liability incurred, nor cause or causes of action accrued or existing, under any Act or Ordinance repealed hereby. 

SECTION 3. The invalidity of any section or provision of this Ordinance or of the Code hereby adopted shall not invalidate any other sections or provisions of this Ordinance or of the said Code. 

SECTION 4. Any ordinances or parts of any ordinances in force at the time that this Ordinance takes effect and inconsistent therewith, specifically Ordinance No. 97-08, are hereby repealed. 

SECTION 5. Any person found to be violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than one hundred dollars ($100) nor more than five hundred dollars ($500) and each day of violation hereof shall constitute a separate offense. In addition, any court having jurisdiction to hear violations of this ordinance may order any remedial or other punishment, such as community service, that it deems appropriate for any person, corporation or entity found guilty of violating this ordinance. 

SECTION 6. The Gassville City Council having determined that the zoning laws within and for the City of Gassville, Arkansas, are inadequate and that the preservation of the health and safety of the said City would be detrimentally affected otherwise, the Council determines that an emergency exists and that this Ordinance shall have full force and effect from and after its passage and approval.
